By using DynaMed, you signify your assent to these Terms and Conditions. If you do not agree to all of these Terms and Conditions of use, do not use DynaMed! DynaMed LLC disclaims any liability for the accuracy, completeness, or functionality of any material contained therein, referred to or linked to, or for any damages arising out of the use or non-use of any materials or other information contained therein, referred to, or linked to. DynaMed LLC reserves the right to change these terms at any time, and the end-user is responsible for revisiting this page to determine current terms and conditions.
Use of Content
DynaMed is not written for laypersons, and is only meant for those persons with adequate medical education and skills. DynaMed is clinically-oriented, and is intended to be used only by licensees who are: 1) physicians and other competent healthcare professionals who will rely on their own discretion and judgment in medical diagnosis, clinical decisions and treatment and 2) researchers who will not use the information for medical diagnosis. DynaMed is not intended for and should not be used as a substitute for the advice of a physician or other health care professional.
DynaMed is intended to serve as a rapidly accessible, initial clinical reference resource and not as a complete reference resource. It does not include information concerning every therapeutic agent, laboratory or diagnostic test or procedure available. The information contained in DynaMed is being provided on an "as is" basis, including errors and omissions that have not yet been identified. DynaMed initially started as medical school notes and has become an internationally used clinical reference tool. DynaMed has been and is continually updated incrementally based on systematic literature surveillance and feedback from users. Patient management decisions should be made by competent health care professionals using their own judgment and experience, and when necessary definitive sources of information.
Health care providers are advised to check the product information sheet included in the package of each drug they plan to administer, as drug information in DynaMed is often incomplete and changes in dosages, contraindications, and drug interactions occur rapidly.
The medical information contained in the database can be printed and distributed in non-electronic formats for personal or nonprofit educational use. You must include the following copyright notice: "Copyright (c) –1993-2009, DynaMed LLC. All rights reserved" and other copyright and proprietary rights notices, if any, contained in the Content. To cite information from DynaMed, refer to How to Cite Information from DynaMed.
Use of the DynaMed website and/or database requires agreement to these terms and conditions, holding DynaMed LLC and any contributors to information within DynaMed harmless for any damages arising out of use of or inability to use DynaMed or the information it contains.
Provision of one's name and password to others is permissible for demonstration purposes only when the licensee assumes responsibility for providing these terms and conditions to others with the explicit understanding that use of the site requires acceptance of these terms and conditions.

The DynaMed database is protected by copyright and is the property of DynaMed LLC. Subscribers are granted a limited license to use the database. No part of DynaMed (e.g. the content, the form of presentation or database design) may be reproduced (e.g. on other Web sites, in other products, or downloaded in bulk) or sold in any form, or by any means, without written permission from the copyright owner. No portion of this site shall be used in any form of commercial exploitation, including, but not limited to, commercial, print, electronic or broadcasting media, and no subscriber or user shall publish as its own any material contained in the DynaMed site.
The Content is protected by copyright under both United States and foreign laws. Title to the Content remains with DynaMed LLC or its licensors. If you violate any of these Terms and Conditions, your permission to use the Content automatically and immediately terminates.
Subscribers and users agree to comply with the Copyright Act of 1976, and agree to indemnify DynaMed LLC against any actions by subscribers or users that are not consistent with the Copyright Act of 1976.
User Submissions and Copyright Transfer
Authors, peer reviewers, editors, commentators and any other contributor to DynaMed who provides summaries, reviews, recommendations, comments or other content, agree to transfer, assign, or otherwise convey all copyright ownership, including any and all rights incidental thereto, exclusively to DynaMed LLC, unless otherwise negotiated with DynaMed LLC.
Users of DynaMed and its contents agree that they will not upload or transmit any communications or content of any type that infringe or violate any rights of any party.
By submitting communications or content to any part of DynaMed, you agree that such submission is non-confidential for all purposes. If you make any such submission, you automatically grant—or warrant that the owner of such content has expressly granted—DynaMed LLC a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, sublicense, perform, and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed.
Liability of DynaMed LLC
The use of the DynaMed Site and the Content is at your own risk.
When using the DynaMed Site, information will be transmitted over a medium which is beyond the control and jurisdiction of DynaMed LLC. Accordingly, DynaMed LLC assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the DynaMed Site.
The DynaMed Site and the content are provided on an "as is" basis, including errors and omissions that have not yet been identified.
DYNAMED LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTIBILITY, NONINFRINGEMENT, OR THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. DYNAMED SHALL NOT IN ANY WAY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF USE OF OR INABILITY TO USE THIS WEB SITE OR THE INFORMATION IT CONTAINS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Specifically, DynaMed LLC, its licensors, and its suppliers make no representations or warranties about the following:
- The accuracy, reliability, completeness, or timeliness of the content, software, text, ICD-9 codes or other codes related to medical billing, graphics, links, or communications provided on or through the use of the DynaMed Site or DynaMed.
- The satisfaction of government regulations requiring disclosure of information on prescription drug products with regard to the content contained on the DynaMed Site.
In no event shall DynaMed LLC, its licensors, its suppliers, or any third parties mentioned on the DynaMed site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the DynaMed Site or the content, whether based on warranty, contract, tort, or any other legal theory, and whether or not DynaMed LLC is advised of the possibility of such damages. DynaMed provides a means of accessing medical information, and is not the direct provider of this information, and does not claim to verify all included information.
DynaMed LLC is not liable for any personal injury, including death, caused by the use or misuse of the site or content. DynaMed LLC shall not be held accountable for any adverse outcomes due to medical management decisions based on information found within or information not found within DynaMed.
General
Neither DynaMed LLC nor its licensors will be liable or deemed to be in default for any delays or failure in performance resulting directly or indirectly from any cause or circumstance beyond its reasonable control, including but not limited to acts of God, war, riot, embargoes, acts of civil or military authority, rain, fire, flood, accidents, earthquake(s), strikes or labor shortages, transportation facilities shortages or failures of equipment, or failures of the Internet.
This Agreement and the license granted herein may not be assigned by the Licensee to any third party without written consent of DynaMed LLC.
If any term or condition of this Agreement is found by a court of competent jurisdiction or administrative agency to be invalid or unenforceable, the remaining terms and conditions thereof shall remain in full force and effect so long as a valid Agreement is in effect.
If the licensee and/or sites use purchase orders in conjunction with this Agreement, then the licensee and/or sites agree that the following statement is hereby automatically made part of such purchase orders: "The terms and conditions set forth in the DynaMed LLC License Agreement are made part of this purchase order and are in lieu of all terms and conditions, express or implied, in this purchase order, including any renewals hereof."
This Agreement represents the entire agreement and understanding of the parties with respect to the subject matter hereof and supersedes any and all prior agreements and understandings, written and/or oral. There are no representations, warranties, promises, covenants or undertakings, except as described here.
Privacy Policy
Personal identification data collected from individuals during DynaMed LLC registration (including e-mail addresses) will not be shared with third parties without written or electronic consent.. E-mail addresses will not be sold, leased, or otherwise made available to third parties for commercial use without written or electronic consent. E-mail sent from DynaMed will be limited to e-mails related to DynaMed activities.
DynaMed LLC reserves the right to disclose your personal identifying information if we are required to do so by law, or in the good faith belief that disclosure of the information is reasonably necessary to comply with legal process, to respond to claims, or to protect or advance the rights, property, safety, or well-being of our company, our employees, customers, or the public.
DynaMed LLC has taken steps to ensure that personal identifying information collected in the future is secure, and we have limited the number of people who have access to the information, by electronic security systems and password protections that guard against unauthorized access. DynaMed LLC provides links to web sites outside of DynaMed LLC. These web sites may not have the same privacy policies as DynaMed LLC. DynaMed LLC takes reasonable care in recommending these web sites but is not responsible for their content or privacy policies. We urge users to read the privacy statement of an outside web site when leaving our site and linking to an outside web site.
